Judge dismisses Nirvana Nevermind baby album cover lawsuit

Spencer Elden's lawsuit against Nirvana for their Nevermind album cover which featured him as a baby has been dismissed by a judge.

Back in August 2021, Elden, who was photographed as a four-month-old for Nirvana's Nevermind album, filed a lawsuit against 15 defendants including the band's Krist Novoselic and Dave Grohl, the late Kurt Cobain and his estate (including Courtney Love, who is executor of his estate), photographer Kirk Weddle, and multiple record labels.

The original lawsuit alleged that the defendants violated "federal criminal child pornography statutes", and Elden was seeking damages of $150,000 (£109,000).

A judge dismissed the original lawsuit back in January, and Elden refiled his lawsuit against the band soon after.

Yesterday (4 September) it was reported (via Deadline) that US District Judge Fernando Olguin of Los Angeles had dismissed the lawsuit, saying Elden, who is now 31, had waited too long to take legal action. According to the piece, the latest dismissal means Elden can't file a fourth version of the lawsuit.

Over the weekend Dave Grohl, his daughter Violet, Liam Gallagher, Sir Paul McCartney and many more played the Taylor Hawkins Tribute Concert at Wembley Stadium.
