Dua Lipa is set to face another lawsuit over "Levitating"
Just two months after winning a dismissal for an earlier copyright claim, Dua Lipa is hit with another lawsuit.
Back in June, Dua Lipa and Warner Records managed to convince a Los Angeles federal to dismiss a lawsuit filed by a group who claimed that "Levitating" is taken from one of their songs – earlier this year, Florida reggae band Artikal Sound System filed a copyright infringement lawsuit against Dua Lipa, alleging that she ripped off their 2017 track "Live Your Life" whilst making "Levitating".
Now, producer Bosko Kante has filed a lawsuit against Dua Lipa for improper use of a talk box performance that is used on the song. Having previously worked with Kanye West and Big Boi, Kante launched a company which sells a digital version of the device. During the same year, he alleges that he was approached by one of the producers of "Levitating", asking if they could incorporated a talk box into the track.
Kante says he agreed to this, but their deal did not give them the rights to use the sample on any remixes including the subsequent releases from DaBaby, and The Blessed Madonna, which also features Missy Elliott and Madonna.
“All three remixes sampled and incorporated a greater amount of plaintiff’s work than that used in the original version,” Kante’s lawyers added. “Defendants did not seek or receive any authorization or permission to use the composition or sound recording of plaintiff’s work from plaintiff.”
The lawsuit, which was filed in Los Angeles on Monday, claims Bosko is entitled to more than $20m (£15.6m).
Dua Lipa and her label Warner Music Group are yet to respond to the claims.
